Divorce
- Also known as “dissolution”
- Termination of the marriage contract
- Legal implications for both parties
Legal Separation
- Spouses live apart from each other while still legally married
- Does not legally terminate the marital relationship, it can still have binding legal implications
- Can be temporary or permanent
Annulment
- Declaring a marriage null and void, as if it never existed
- Retroactively invalidates the marriage
- Granted for various reasons, including fraud, duress, incapacity, or lack of legal capacity to consent to marriage
- Could have other legal implications
NOTE: If you and your spouse cannot agree on the ultimate outcome, and one of you wants a legal separation and the other wants a divorce, it is most likely you will have to proceed with a divorce.
