Questions

How do I know if my spouse’s client list or goodwill has value to be looked at in divorce?

The main question to ask about intangible business assets is whether or not a third party would pay for this business? Ask yourself if the business itself would have value if your spouse stopped working there.  If there is value without your spouse, the intangibles in the business may have value to be looked at in the property division analysis. If the business has no value without your spouse, then the business value may not be included in the property division.
