Why are my student loans not a shared/marital debt?
As long as student loans are used for education expenses only, like tuition and books, then the debt typically follows the education. If a doctor incurred a lot of student loans for medical school, then the doctor will presumably have income commensurate with the education and be able to cover the debts with a doctor salary. So student loans go with the spouse who incurred the debt. There is an exception if student loans were used for shared expenses like house payments or child care during the marriage. The portion of student loans used for marital/joint expenses are often shared or considered marital/joint.
