Why do I have to share retirement when I am the one that earned it all?
Retirement earned during a marriage is considered marital/shared property regardless of who earned it. Any funds that were diverted into retirement during the marriage could have been shared between you. Making the choice to save for retirement is considered a joint decision during the marriage, so in a divorce, the retirement is considered shared. While you can voluntarily choose to each keep your own retirement, if there is disagreement, most jurisdictions will share retirement from during the marriage in an equal or equitable way.
